Guilty plea for 2nd degree murder while driving under the influence

The incident occurred when Diaz drove his car on Rose Avenue in the city of Oxnard with a blood alcohol content of 0.22 percent. Diaz swerved into the bicycle lane near Channel Islands High School where he struck and killed the victim, who was riding his bicycle with a friend. Diaz was previously convicted of driving under the influence in 2008. During that case, Diaz was advised by the court that if he continued to drive under the influence of alcohol and caused the death of another, he could be charged with second-degree murder. The defendant was also arrested for driving under the influence in 2009 after which he failed to appear in court.
The defendant faces 15 years to life in state prison at the time of sentencing, which is set for May 24, 2016, at 8:30 a.m. in courtroom 48 of the Ventura Superior Court. The defendant is being held without bail.
