The New DOJ Asset Forfeiture Scheme and How to Stop It

A couple weeks ago, at the behest of Jeff Sessions, the U.S. Department of Justice issued a new directive meant to ramp up asset forfeiture across the country – even in states that require criminal convictions first.  Today, Mike Maharrey and I sat down to talk about this for episode 21 of Tenther Tuesday.

We discussed what asset forfeiture is, along with the federal “equitable sharing” program.  We also went over a timeline of the federal program, from Holder and Lynch to this new directive from Sessions. And more importantly, we gave an overview of how states can stop it.
