Oxnard PD arrest man for PROS Violations

decease arial, sans-serif; font-size: 12pt;”>On 7-22-16, at approximately 10:00 AM, Officers from the Oxnard Police Department Neighborhood Policing Team conducted a traffic stop at Patterson Road and Wooley Road.  The driver of the vehicle was identified as Rafael Arias who is a Post Release Offender (PROS) and convicted Felon. Officers noticed that Arias was extremely nervous when they contacted him conducted a compliance search of his person and his vehicle.

During the search a quantity of methamphetamine was found in his pockets and also in his car. Officers also found several rounds of small caliber ammunition in his vehicle. Because of Arias’ long criminal history, he is considered a prohibited person from possessing firearms and ammunition. Arias was arrested for Felony transportation of narcotics and for being a prohibited person in possession of ammunition, also a Felony.

The Post Release Offender program was created by Assembly Bill 109 – the 2011 Public Safety Realignment. This program mandates that individuals sentenced to non-violent, non-serious or non-sex offenses will serve their sentences in county jails instead of state prison.  The public should be aware that release under AB 109 is based on the offender’s most recent commitment offense, prior convictions are not considered.

Great politicians making laws to release serious offenders on the general public while making overtures of making it harder for decent citizens to protect themselves from this scum.

Someone elected these great producers of laws that give breaks to criminals and make normally law abiding citizens, targets.
