Oxnard: Post Release Offender (PRO) arrested for trespassing and violation of probation
thumb times; font-size: 16px;”>5pm May 17th, Saturday officers from the Oxnard Police Department were provided information from a witness that a male subject, later identified as Anthony Martinez, 24 years of Oxnard, was in the public restroom at Marina West Park and was in possession of a handgun. The witness advised that the Martinez was not threatening anyone in the park. When officers arrived, Martinez ran and hid inside of a residence in the 2200 block of Miramar Walk. Police learned that Martinez did not live at the residence which was occupied by a male homeowner and his juvenile daughter. The house was surrounded and Martinez was taken into custody as he attempted to flee out the back door. The area was searched but no handgun was located.
Martinez was arrested for trespassing, violation of probation, and for obstructing or delaying a peace officer in the performance of his/her duties. He was booked into the Ventura County Jail.
Martinez is currently in the Post Release Offender Program, created by Assembly Bill 109 – the 2011 Public Safety Realignment – which was effective October 1, 2011. This program mandates that individuals sentenced to non-violent, non-serious (irrespective of priors) or non-sex offenses will serve their sentences in county jails instead of state prison. The public should be aware that release under AB 109 is based on the offender’s most recent committing offense. Prior convictions arenot considered.
