    Will the next Supreme Court term be a sleeper or a blockbuster? It may be too soon to tell, but the justices certainly have not shied away from hot button issues this presidential election year.

    The cases already on the Court’s docket raise significant constitutional and statutory issues, including: yet another challenge to the Affordable Care Act, religious discrimination in a state foster care system, whether the government is on the hook for nominal damages when it abandons an unconstitutional policy after a lawsuit was filed, a challenge to the structure of the Federal Housing Finance Agency, and several immigration cases. Ballot harvesting and other election-related matters, as well as challenges to the judge-made qualified immunity and deference doctrines, may be added later in the term.

    Our distinguished panel members will focus on the most significant cases, including those the Court selects during its September 29 “Long Conference.” They will also highlight promising cert. petitions that may be granted later in the term.
