    Gym Ordered to Cease Indoor Operations in Violation of State and Local Health Order

    VENTURA, California – District Attorney Gregory D. Totten announced today that the District Attorney’s Office Consumer and Environmental Protection Unit obtained a Temporary Restraining Order (TRO) today against BSF Fitness (BSF). BSF is gym located in the City of Ventura. The TRO orders BSF to comply with state and local health orders which currently prohibit indoor operations by gyms and fitness centers. The District Attorney’s Office had previously filed a civil complaint against BSF alleging a violation of California’s Unfair Competition Law, in response to BSF’s failure to cease indoor operations during the Covid-19 pandemic, as required by law. The TRO requires BSF to abide by the terms of the state and local health orders until the court determines whether a preliminary injunction is appropriate in order to enjoin similar conduct during the pendency of the case.

    Local officials have made numerous requests that BSF Fitness comply with the law by ceasing indoor operations while prohibited by state and local health orders. Despite these requests, BSF Fitness has continued to operate in violation of state and local health requirements.

    An Order to Show Cause regarding the issuance of a preliminary injunction is set for August 31, 2020, at 10:00 a.m. in courtroom 42 of the Ventura County Superior Court.

    David:

    For all anyone knows, this could be one person snitching on businesses. I say the same thing about businesses as I do about Churches…..It’s the obligation of The State to prove specifically IF attendees of a business or Church are infected and spreading the virus to potentially “at risk” people. It should never be the obligation of any entity to prove their innocence.

    All this while demonstrators are not thought of as the potential spreaders of the virus.

    These are the same people my son and his companies have been supporting. Now he is in the identical situation with his Martial Arts Studios.

    Zoning and Code Enforcement are going from Business to Business alleging complaints on their COVID snitch line and shutting companies down and fining them based on anonymous complaints.

    In the case of gyms, martial arts studios, churches, the CITY, being directed by Ventura City Council is ordering this. When questioned they point to the County authorities.

    But make no mistake. It is the Ventura City Council behind all of this, as Ventura is a Charter City and they have been indicted for using this modus prior.

    I suspect that this is where the current situation will wind up, as the businesses litigate and demand to be shown just cause, to confront their accusers, and are able to prove that no active threat to public health is proven to have existed in their businesses.

    It is my hope that those on Council who did this (it was not the entire Council) are held personally liable in the end, have their homes taken and are run out of this Community.

    Rob McCoy and his church presented them with a $15,000 check to help out last night during his video to the congregation. I thought that was a very kind gesture
