Oxnard Police Department – Incident Press Release
On January 15, 2021, at about 11:15 PM, an officer was patrolling an apartment complex in the 200 block of W. Vineyard Avenue when he conducted a traffic stop on a suspicious vehicle with three occupants inside. Two of the occupants were on Post Release Community Supervision (PRCS).
During a pat-down search of passenger Rogelio Burgos, on PRCS, the Officer located a loaded 9mm handgun in Burgos’ front pocket. The serial number was obliterated. As the Officer continued to search Burgos, an additional loaded magazine was located in Burgos’ shirt pocket. Burgos was arrested for three felony firearm related charges. The driver of the vehicle, Eddie Rojo (age 27), also on PRCS, was arrested for violating the terms of his PRCS. A second unidentified passenger in the vehicle was arrested for the misdemeanor charges of possession of a small quantity of methamphetamine and possession of drug paraphernalia.
The Post Release Offender Program was created in 2011 by Assembly Bill 109 (Public Safety Realignment). The program mandates that individuals sentenced to non-violent, non-serious or non-sex related felony offenses will serve their sentences in county jails instead of state prison. Release under AB 109 is based on the offender’s most recent commitment offense and prior convictions are not considered.
