    Open Letter Demanding Binding Resolution on Vaccine Passports from the Ventura County Board of Supervisors

    We, the people, respectfully and intentionally remind you that you are elected representatives, put into office at our good pleasure to represent our best interests and to defend or constitutional freedoms and civil liberties. The below items must be acknowledged and acted upon by our Board of Supervisors immediately. Our civil rights, human dignity, and right to choose what happens to our own bodies is being violated on a massive scale in this county and will not stand. We will choose what happens to our own bodies and under the clearly stated Informed Consent standards listed on the website of the FDA https://www.fda.gov/regulatory-information/search-fda-guidance-documents/guide-informed-consent and clearly codified into international human rights law in the Nuremberg Code of 1947 http://www.cirp.org/library/ethics/nuremberg/, will assess the data and science for ourselves, consult with our own individually selected healthcare professionals, and will then choose our own path forward as sovereign and free beings. You may not violate fundamental ethics, the American Constitution, the CA Constitution, Civil Rights & Statutory Law, and International Human Rights Law in your role as Supervisors in this county, and we urge you in the strongest terms to reject completely any and all contracts and efforts seeking to require proof of vaccination for individuals to function, buy and sell within society, and/or to conduct business of all kinds. This is so fundamentally discriminatory in nature that it should go without saying. 

    All of the Covid-19 “vaccines” are Emergency Use Authorization, none are FDA approved. These are experimental biological agents and  the number of cases and deaths reported to VAERS are cause for alarm. You may be held personally liable should you allow any establishment in this county to force proof of vaccination on residents without informed consent, should they be injured or killed by said vaccines.

    “EUA products are by definition experimental and thus require the right to refuse. Under the Nuremberg Code, the foundation of ethical medicine, no one may be coerced to participate in a medical experiment. Consent of the individual is “absolutely essential.” A federal court held that the U.S. military could not mandate EUA vaccines to soldiers. Doe #1 v. Rumsfeld, 297 F.Supp.2d 119 (2003). The court held: “…the United States cannot demand that members of the armed forces also serve as guinea pigs for experimental drugs.” Id. at 135. No court has ever upheld a mandate for an EUA vaccine.”

    “When talking about the risk/benefit ratio of any treatment we must consider the Infection Fatality Ratio or IFR. The IFR for COVID-19 varies dramatically by age, from a low of 0.003% for Americans under age 19 to as high as 5.4% for those 70 years of age and above.19 That is an 1800x risk difference based upon age! It is quite clear that young people are at a statistically insignificant risk of death from COVID-19. Nearly 80% of all coronavirus-related deaths in the US through November 28, 2020 have occurred in adults 65 years of age and older and only 6% of the deaths had COVID-19 as the only cause mentioned.     We have the freedom and the right to make our own medical choices. Please know that we will not go along with allowing for or instituting any kind of vaccine passport system whether it is officially approved through the county or simply enabled to be utilized by private establishments in violations of our free and equal access as protected under law [California Civil Code Section 51, 54-55.2]

    Unequivocally end these human rights violations now and allow us to return to functioning as free and sovereign citizens, perfectly capable of making our own best health and life decisions.

    On May 19th I received an email response from Ashley Bautista, County of Ventura Public Information Officer, stating: 

    Ms. Proctor, The County of Ventura does not have a vaccine passport requirement. Vaccines are completely optional. It is your personal choice. The Board of Supervisors has never considered a vaccine passport. We do not have a contract with Othena and have never considered a contract with a business of that name. Have a good day, Ashley”

    I responded: “What we desire to see from our elected representatives is that they represent us; which means protecting and defending these human rights laws which ensure that our medical sovereignty, right to privacy, and informed consent remain fully intact.”

    Our Board of Supervisors must sign a Binding Resolution to this effect. Example here:

    And please remember the following points of law [ref. from TheHealthyAmerican.org] to which you will be held accountable:

    1.     Digital vaccine passports of any kind are discriminatory against those based on their medical status, religious beliefs and more.  Requiring a vaccine as a condition to participate in society is unlawful, immoral, unethical and unthinkable.

    2.     Private businesses are NOT above the law and they are PROHIBITED from implementing any such verification program as a condition of doing business.

    3.     We are demanding that this board:

            a.     Publicly state its opposition to the vaccine passport; and

            b.     Prohibit businesses from requiring a vaccine verification to get service

    4.     California Government Code 12926 (q) protects one’s religious liberty and practice, including the ability to NOT PARTICIPATE in practices that violate one’s sincerely held religious beliefs 

    5.     California Government Code 37100 states that NO county, municipality, or legislative body may pass or enforce a law that violates the laws of this state or the laws of the United States.

    6.     It is unlawful, unethical, immoral and unthinkable to state that private businesses can require a vaccine passport or vaccine verification as a condition for conducting business. 

    California Civil Code 51 states that:

    All persons within the jurisdiction of this state are free and equal, and no matter what their sex, race, color, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, sexual orientation, citizenship, primary language, or immigration status are entitled to the full and equal accommodations, advantages, facilities, privileges, or services in all business establishments of every kind whatsoever.

    7.     California Health and Safety code 101080 states that a local health emergency can only be called where there is an ‘IMMINENT AND PROXIMATE THREAT of the INTRODUCTION of a contagious disease…” and this local health emergency EXPIRES AFTER SEVEN DAYS. The local health emergency was called in Feb of 2020; this is 15 months later. THERE IS NO EMERGENCY! There is no imminent and proximate threat of an introduction of a contagious disease.

    8. Requiring a Covid vaccine (which is a medical experiment) as a condition to participate in society is UNLAWFUL COERCION according to CA law.

    24170: This is the Protection of Human Subjects in Medical Experimentation Ac

    24171: The Legislature hereby finds and declares … the right of individuals to determine what is done to their own bodies.

    24172 (j) This is the “experimental subject’s bill of rights,” and states that individuals

    Be given the opportunity to decide to consent or not to consent to a medical experiment without the intervention of any element of force, fraud, deceit, duress, coercion, or undue influence on the subject’s decision.

    Do not violate our Constitutional rights. A vaccine “passport” will not be acceptable, and if we need to take this issue all the way to the Supreme Court, so be it, but the BOS will be liable for the costs, and penalties.
    Do not test our resolve to remain free, and this is an attempt to take that away from us.

    Thank you, Charissa, for clearly stating our legal rights and for informing our Ventura County Supervisors that they were elected to protect the Constitutional rights of we, the citizens, of Ventura County. We must stand together against the tyrannical overstepping of authority by city, county, state and national elected officials. We have forgotten our status and power as Americans. Time to remember.
